Democrats challenge federal pressure on election officials ahead of midterms

Democratic leaders are asking a federal court in Washington to stop the Trump administration from directing states to remove registered voters or withhold ballots ahead of the November 3 midterm elections. Associated Press reported the challenge on October 21, following the complaint’s filing on October 20.

The complaint names President Donald Trump and the Justice and Homeland Security departments as defendants. Plaintiffs include congressional Democratic leaders Chuck Schumer and Hakeem Jeffries, the party’s Senate and House campaign committees and the Democratic Governors Association, according to the filing.

The plaintiffs allege that federal officials have used threats of prosecution to pressure state and local election administrators. They seek protection against demands to deny or set aside lawful ballots, arguing that the executive branch is exceeding its authority. Those claims are allegations in the lawsuit, not findings by a judge.

California is central to the dispute. AP reported that the Justice Department separately sought to prevent the counting of mail ballots from people it identified as likely noncitizens until their status could be confirmed. The Democratic complaint disputes the reliability of federal lists and says lawful voters risk losing their votes.

The administration defends its approach. The Justice Department told AP that protecting election integrity is a priority and that its actions are grounded in law and being litigated in court. A White House spokesperson told Axios that the administration is taking lawful steps against election crime, fraud and coercion.

AP reported that Chief Judge James Boasberg was assigned the case. With the election approaching, the plaintiffs are seeking judicial orders limiting federal intervention and threats against election officials. The filing itself does not change voting rules; the requested restrictions depend on further court action.
